Ocasio-Cortez: Illegal aliens detained by ICE ‘have not committed a crime’

Under Title 5, Section 3331 of the United States Code, incoming members of Congress take an oath, which reads: “I, [name], do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion, and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”

Rep. Alexandria Ocasio-Cortez took that oath on Jan. 4, 2019. The question of whether she has lived up to that pledge was raised in a recent live stream discussion in which she  made the curious assertion that illegal aliens detained by ICE “have not committed a crime.”

The New York Democrat was commenting on President Trump’s plan to suspend immigration in the midst of the coronavirus pandemic currently gripping the nation. “If he is gonna do this for public health reasons, we need to be suspending these deportations right now,” she countered, adding that illegals currently being detained have committed no crime. No, they’ve just been locked up on ‘procedural issues.'”

Which brings us back to the congresswoman’s oath. Among the laws she is swearing to uphold is Title 8, Section 1325 of the U.S. Code, which makes it a crime to unlawfully enter the United States. The law specifies:

Any alien who (1) enters or attempts to enter the United States at any time or place other than as designated by immigration officers, or (2) eludes examination or inspection by immigration officers, or (3) attempts to enter or obtains entry to the United States by a willfully false or misleading representation or the willful concealment of a material fact, shall, for the first commission of any such offense, be fined under title 18 or imprisoned not more than 6 months, or both, and, for a subsequent commission of any such offense, be fined under title 18, or imprisoned not more than 2 years, or both.

Facts are not something Ocasio-Cortez is interested in, however. She doesn’t want to hear about crimes being committed. She’d rather whistle past the graveyard.

Former Immigration and Customs Enforcement (ICE) Acting Director Tom Homan has released a book in which he emphasized that illegal immigration is not a victimless crime.

Homan points out that even those illegal aliens who enter the country with the best intentions often have to bribe a drug cartel or smuggling organization to get them across the border. Which means they’re funding violent organizations, itself a crime.
