The fact that the Obama administration disagreed with the Supreme Court ruling in the Hobby Lobby case was wholly predictable. What was not was the official statement released by new White House mouthpiece Josh Earnest, who said of the ruling:
We disagree and the constitutional lawyer in the Oval Office disagrees with that conclusion from the Supreme Court.
Hey, that’s right. Obama does claim he played a Constitutional lawyer back when he was in law school. So, he has the wind at his back legally speaking as he now articulates a plan to take unilateral executive action on immigration reform in the face of the House Republican recalcitrance. Should be a piece of cake, right?
That was the question put in essence to two other Constitutional lawyers. One of them is Jeffrey Toobin, who is hardly conservative in his views. He appeared on CNN where he declared that Obama’s plan to go it alone is “not necessarily the way the Constitution set it up.”
Another is Jonathan Turley, also an Obama supporter and sympathizer. Turley who teaches law at George Washington University Law School, appeared before Congress last December and said this:
The danger is quite severe. The problem with what the president is doing is that he’s not simply posing a danger to the constitutional system. He’s becoming the very danger the Constitution was designed to avoid. That is the concentration of power in every single branch.
