Halle Berry’s ex-husband Olivier Martinez obtained a temporary restraining order against the actress after accusing her of abusing their son, Maceo.
Martinez alleged that Berry physically assaulted their 12-year-old child Sept. 26 by jumping on him, putting her hands around his neck and putting him in a chokehold, according to TMZ. He also claimed there were previous attacks, and alleged that Berry threatened to have him deported.
The court filing stated Maceo was at home with Berry and her boyfriend Van Hunt, and was playing video games when the alleged incident unfolded. He was playing video games when the alleged incident unfolded, Berry entered the room and told her son he looked “so stupid” and said he was “such an idiot” for gaming, TMZ reported.
Martinez reported that Berry’s anger escalated into a physical altercation and alleged that she jumped on their son, grabbed him by the neck and began choking him while shouting, “Who is dominant now?!” according to the outlet.
Martinez claimed that Berry texted him the day after the alleged incident, saying, “I feel terrible about what happened last night as I know he does as well.”
The legal documents cite other alleged incidents of violence, including claims that Berry struck Maceo in the face 5 years ago. Martinez alleged that Berry had a very violent outburst 10 years ago and threw a plate with a knife and fork on top and said that during their 2023 discussions about child support, Berry told their son that his father was “a white bitch robbing money from a black woman,” the outlet reported.
The temporary restraining order requires Berry to remain 100 yards away from Martinez and only permits her to see Maceo during court-ordered visitations two days a week and every other weekend. (RELATED: Police Arrest Rick Ross On Charges Of Felony Battery By Strangulation)
The court ordered Martinez and Berry to participate in confidential mediation to determine custody, and stated that the famous actress must not drink or be under the influence of alcohol or any other substances while in Maceo’s presence. She must undergo sobriety testing before, during or after visitation, according to TMZ.
Martinez is requesting sole custody of Maceo.
The outlet reported that a hearing is scheduled for Oct. 16.
