Empire State Building management has filed a $1.1 million lawsuit against a photographer for taking pictures of a topless woman at the skyscraper’s packed 86th floor observatory.
In papers filed in Manhattan Supreme Court, ESRT Empire State Building says photographer Allen Henson caused “damage to its business and reputation as a safe and secure family friendly tourist attraction” by taking pictures of a woman without her shirt on there this past August 9.
“Breasts are dangerous? I’ll take the publicity but it’s hard to take this seriously,” Henson, 29, told the Daily News.
The building’s suit sniffs that Henson, a professional photographer, hadn’t filed an application to do a photo shoot at the observatory – and the building wouldn’t have granted him permission if he had.
