With another company, Walmart, cutting ties with Paula Deen over blatantly racist comments she made about employees, you’d think that the fallen celebrity chef would be ready to quietly accept her new status as food-world pariah. You’d think wrong. Radar Online reports that Deen continues to fight the bad fight, earning herself and her codefendants a contempt-of-court citation for refusing to surrender a blooper reel of “obscene and vulgar video outtakes” from her show.
The video is said to feature Deen using assorted four-letter words (including “motherf**ker”), describing a dish as smelling like a “stinky coochie,” and pretending to perform fellatio on a pastry before declaring, “My a** ain’t pretty no more!”
Lisa Jackson, a former manager at Deen’s Savannah, Ga., restaurant, who brought the $1.2 million lawsuit, wants to use the blooper reel as part of her litigation, during depositions, and at trial. Her lawyer, Matthew Billips, had warned the defendants that he would file a motion for contempt if the reel were not handed over by Monday, May 6, 2013. When that date came and went, he made good on his threat, pleading:
Defendants simply ignored those requests, often not even responding. As such, there can be no conclusion that can be reached other than the Defendants are in willful Contempt.
A party or its counsel who blithely disregards an Order to produce evidence does so at its own risk. Defendants have been Ordered to produce the Blooper Reel video and have no excuse for refusing to do so.
U.S. Magistrate Judge G.R Smith granted the motion on May 8, ordering the celebrity chef and her codefendants to “promptly deliver a copy of the blooper reel to plaintiff’s counsel, who are entrusted with its confidentiality,” or be found in contempt.
The defendants have reportedly agreed to produce the tape since being found in contempt. Deen and her brother, Earl ‘Bubba’ Hiers, are being sued for sexual harassment, frequently using the N-word to refer to Jackson and others, and watching pornography on work computers.
